Article 13: Guarantees

13.1 Legal Warranty of Compliance

The products offered by Vaudou Sport benefit from the provisions of the French legal articles of 1641 and the following of the French Civil Code relating to the legal guarantee of conformity. In case of dispute or claim, the date taken into consideration for the calculation of the guarantee period will be that of the delivery of the goods, formalized by the contract of sale or the delivery note.

The law states that the seller is obliged to deliver goods in conformity with the contract and is liable for defects of conformity existing upon delivery. It also answers to the defects of conformity resulting from the packaging, the assembly instructions, or the installation when this was charged to it by the contract or was carried out under its responsibility. The action resulting from the lack of conformity is prescribed by two years from the delivery of the property.

13.2 Commercial Warranty

The warranty period starts from the date of delivery indicated on the order form. The duration is specified below. The warranty covers the core of the mattress against abnormal or premature sagging under normal conditions of use, on a suitable mattress and in good condition, protected by a mattress protector. It must never be placed directly on the floor or upon a non-aerated support. You must rotate your mattress (head, foot, front, and back for Reflex mattress) at least once every three months, and once a quarter for the Warrior and Bravery mattresses. The rotation is head to foot, not back to front.

It should be noted that the phase of adaptation to the shape of your body can result in a slight settlement of less than 15% of the packing materials. This is normal and thus can not be guaranteed. Any exchange or repair will not have the effect of extending the duration of the guarantee. In no event shall the warranty cover damage that may be caused by the use of force, accident, environmental disadvantage, attempted repair, or other alterations to the product and damage to the covering fabrics, sewing threads, or any other element of good performance is related to the conditions of use. In order to benefit from the guarantee, the product must be returned to us in a high state of cleanliness, free from any markings, in its original packaging, and accompanied by the original order form or invoice. The order form can be found via the contact section of the website.

Nevertheless, a principle of dilapidation is applied after three years according to the following rules:

  •        -25% from the fourth to the fifth year;
  •        -35% from the fifth to the seventh year;
  •        -60% the rest of the guarantee.

The contractual guarantee can not in any case reduce or eliminate the legal guarantees (in particular guarantee of the latent defects and of nonconformity) to which any buyer has the right.

The "manufacturer's warranty" refers to any defect in the material or workmanship. The most noble and high-performance materials used for the packing and the contact layer can present a slight and normal settlement in use. Normally this loss is less than or equal to 15% of the width of the mattress, and this can not justify a claim and remains within the limits of the tolerance having no measurable effect on the qualities and comfort of the product.

Any mattress that is deformed when used with an unsuitable bed frame may appear more hollow, show roughness, curvature, or spacing between exposed slats of more than 20 cm, or other metal frame with slats not made for adults.

Defects and degradation caused by use and normal wear and tear, or by an external accident (including improper assembly made by the customer, product not maintained by the customer, abnormal use, fire, fall, break, other accidents, abnormal moisture phenomenon or heat, retouches or alterations made to the product, etc.) are excluded from the warranty.

This warranty does not cover the covering, the sewing thread, the zipper (s). Similarly, the warranty shall not apply to apparent defects which the purchaser does not gain from.

The products are manufactured according to the European standard EN 1334 that defines the recommended measurement methods and tolerances. A difference not exceeding 2 centimeters can be observed between the announced dimensions and those observed on the products, taking into account the artisanal finishing done to the handmade products. The thickness of the mattress refers to the maximum distance that separates the two faces of the mattress, measured at the center of the mattress, the mattresses being laid horizontally on a flat surface.

Under the French Article L 211.16, where the buyer asks the seller, during the course of the commercial guarantee granted to them during the acquisition or repair of movable property, to repair the condition covered by the guarantee, any period of immobilisation of at least seven days is added to the duration of the guarantee that is remaining. This period shall run from the buyer's request to the intervention or the making available for repair of the goods in question, if such availability is subsequent to the request for intervention.

In fulfillment of this warranty, our company undertakes to replace free of charge or repair the defective product or component by its services.

Under this guarantee, the sole obligation incumbent on the seller will be, according to his judgment, either the free replacement of the product for an equivalent product, or the repair of the product or the element recognized as defective by the services. Any product required to benefit from the warranty must first be submitted to the after-sales service of the seller whose agreement is essential for any replacement or repair.

For mattresses, the warranty certificate provided describes and sets the warranty conditions. This warranty certificate will be required when the warranty is claimed.

Claims related to the mattress warranty must be sent by registered mail with acknowledgment of receipt to:

23 cours Guynemer
